Plaintiff was injured by an on duty police officer and sought to include third party determinations found in and Internal Affairs report regarding past misconduct on the part of the defendant for purposes of impeaching his credibility as a witness. The court precluded the evidence and the plaintiff appealed. The Appellate Court found in favor of the defendant.
